Terms of service
Last updated 7 October 2026
These terms cover the use of Hephon Commerce, the shopping assistant operated by Hephon ("we", "us"), by retailers that run it ("you") and their staff. A signed order form or agreement with Hephon overrides these terms where they differ.
The service
Hephon Commerce answers shoppers on your behalf: it searches your catalog, fills baskets and hands checkout and complaints to your systems and staff. You get an admin to configure the assistant, review conversations and measure it, an API, webhooks and embeddable chat.
Accounts
Access is by invitation. You are responsible for who you invite, for keeping sign-in details and API keys secret, and for what is done with them. Tell us at once at security@hephon.ai if you think an account or key was misused.
Your data and your catalog
- You keep all rights to your catalog, your brand and the data your shoppers give the assistant. You give us the rights we need to run the service for you.
- You are the controller of your shoppers' personal data and we are your processor. The data processing agreement is part of these terms.
- You make sure you may share your catalog and shopper data with us, and that your own privacy notice tells shoppers about the assistant.
What the assistant does and does not do
- It only offers products, prices and stock from the catalog you give it, and it asks your systems for live stock where you connect them. Prices and stock in your own systems are the ones that count at checkout.
- It does not place orders, take payments or give medical, legal or financial advice.
- It is an AI system and can make mistakes. Review its configuration and test it (the Evals page benches it) before you publish a change.
Acceptable use
Do not use the service to break the law, to send spam, to sell restricted goods without the checks the law requires, to probe or overload the service, to try to reach other retailers' data, or to build a competing product from its outputs.
Fees
Fees, limits and invoicing are set in your order form. We may pause the assistant's model replies when a spending cap you set is reached; shoppers then get a fixed reply.
Availability and changes
We aim for the service to be available at all times but do not promise it will be uninterrupted. We may improve or change features; we tell you in advance about changes that reduce what you get.
Ending the service
You can stop at any time under your order form. We may suspend access for a serious breach of these terms or to protect the service. When the service ends you can export your data for 30 days, after which we delete it, as set out in the DPA.
Liability
To the extent the law allows, neither side is liable for indirect or consequential losses, and each side's total liability is capped at the fees paid in the 12 months before the claim. Nothing limits liability that cannot be limited by law.
Law
These terms are governed by the law named in your order form.
